Terms and Conditions
For MLA Events
Important: You must read these terms carefully because they include provisions that affect your ability to recover damages for loss you may suffer while attending an Event and allow MLA to disclose your personal information to third parties in accordance with MLA’s Privacy Policy.
1. These terms
These terms set out the conditions that apply to your registration for, and attendance at, Events advertised by MLA.
Each reference in these terms to:
- “Event” includes any activity run by MLA or its third party contractors which is advertised by MLA and open to attendance by individuals who register to attend, including activities held in person or online;
- “MLA” means Meat & Livestock Australia Limited (ACN 081 678 364), its subsidiary Industry Systems Company Limited (ABN 34 134 745 038) or its donor company, MLA Donor Company Limited (ABN 49 083 304 867); and
- “you/your” means the individual or business registering for and/or purchasing tickets or attending an Event.
- By registering for an Event, you agree to comply with these terms. If you are booking on behalf of someone else, you must ensure these terms are made available to each person for whom you register prior to the Event. If any individual for whom you register does not agree to these terms, you must notify MLA of the cancellation of that person’s registration.
MLA and its third party contractors may impose additional terms and conditions for certain Events. It is your responsibility to review these additional terms notified to you for the Event carefully before you make a registration.
Please refer to the terms listed on MLA’s website for a copy of the most recent terms before registering for an Event, as MLA may update these terms from time to time.
2. Events
(a) Your obligations
When participating in or attending an Event, you must comply with these terms, any additional terms and conditions notified to you for the Event at the time of registration and all applicable laws.
(b) Registration fees
Some Events may require a registration fee. If this is the case, the fee covers entry to the Event and any applicable GST.
You are responsible for any ancillary costs associated with attending the Event, such as the cost of any travel, food, accommodation, vaccinations or personal protective equipment (PPE) required to attend the Event (if applicable). You agree that you will not seek payment or compensation from MLA for such costs for any reason, including if the Event is delayed, postponed or cancelled.
(c) Delay, Postponement or Cancellation and refunds
From time to time circumstances may require MLA to delay the start time of any part of an Event. MLA will not refund your registration fee if a delay occurs.
MLA may also postpone or cancel an Event at any time. Where MLA postpones or cancels an Event, MLA will refund any registration fee you have paid.
You must notify MLA in writing as soon as possible if you need to cancel your registration to an Event for any reason. If you have paid a registration fee and you notify MLA of a cancellation in writing:
- at least 28 days prior to the start of the Event, MLA will refund the registration fee in full; and
- less than 28 days prior to the start of the Event, MLA will refund part of the registration fee and MLA may retain such part of the registration fee which is proportionate to the loss suffered by MLA as a result of the late cancellation.
MLA will not refund any registration fees if you are refused entry to an Event or are removed from an Event for failure to adhere to these terms and any additional rules, policies, procedures and directions provided by MLA or the management of a site on which an Event is held.
(d) Events at Risky Sites
Events may be held at sites that present health and safety risks, such as sites that contain animals, heavy machinery or which are located in areas that are prone to natural disasters such as fires or floods (“Risky Sites”).
When attending Events at Risky Sites you acknowledge that you:
- will be subject to any additional rules, policies, procedures and directions provided by the Risky Site and may be required to complete a biosecurity risk assessment and/or take certain safety precautions such as wearing personal protective equipment or taking a chemical footbath; and
- may be refused entry to or removed from the Risky Site if you fail to follow any additional rules, policies, procedures and directions provided by the Risky Site.
You attend Events at Risky Sites at your own risk and bear all liability including damage or loss that you may incur to your person or property or cause or cause or contribute to the loss or damage to a person or property. To the extent permitted by law, by entering a Risky Site you release MLA and the operator of the Risky Site from all claims and liability in connection with your attendance at a Risky Site.
(e) Events with Q-Fever risk
Events may present the risk of exposure to Q-Fever. By making a registration or purchasing tickets to such Event you acknowledge that you bear the risk of attending the Event.
Q-Fever is an infectious disease, transmitted through infected fluids or dust particles, which can cause severe illness and long-term health issues. If you work directly with cattle or visit a site for an Event where livestock are present you are at risk of potentially contracting or being exposed to Q-Fever
If you have not been immunised there is a possibility you may be exposed to Q-Fever during your attendance at any Event where livestock are present and you understand that you attend such Event at your own risk.
A Q-Fever immunisation is highly recommended to all visitors who attend Events at sites such as a farming operation, saleyard, feedlot, processor, or people who are exposed to livestock, animal products and animal excreta. Following vaccination against Q-Fever there is a “window” period of non-immunity between vaccination and immunity which research suggests is approximately 15 days. Please take this into consideration before attending an Event which might be at risk of Q-Fever exposure.
For further information on Q-Fever please refer to the following sources:
(f) Limitation of liability
While MLA will take reasonable measures to ensure the safety of its Events, including implementing any safety precautions recommended by Event sites, site operators or public health authorities, you attend the Event at your own risk. To the extent permitted by law, MLA will not be liable for any damage or loss suffered or incurred by you (including damage to property, injuries or illness) as a result of your attendance at an Event.
By registering for an Event, you acknowledge and accept these terms in your personal capacity and on behalf of any other person for whom you register, including any accompanying minor.
(g) Force majeure
MLA’s obligations, including to hold Events you have registered for, may be suspended due to circumstances outside MLA’s reasonable control, such as Government directives, extreme weather or natural disasters, fire, industrial action, electricity, power or communications failures or shortages, epidemics, pandemics or other widespread risks to public health or changes to law (“Force Majeure Event”).
If a Force Majeure Event occurs, MLA may reschedule or cancel the Event, or implement reasonable work around solutions (such as using video technology to hold Events that would normally be held in person). Please see the “Cancellation and refunds” section above for information on refunds.
MLA will not be responsible for any loss or expense suffered or incurred by you (including travel costs or other costs ancillary to the Event registration fee) as a result of, and to the extent that, MLA is unable to perform or is delayed in performing its obligations because of the Force Majeure Event.
3. Privacy
(a) Consent to collection and use of personal information
MLA will manage any personal information that it collects through your registration or at an Event in accordance with MLA’s Privacy Policy, which you can access at https://www.mla.com.au/general/privacy/.
By attending an Event or by submitting any information to MLA, you agree to the collection and use by MLA of your personal information in accordance with this policy.
(b) Disclosure of personal information to third parties
You consent to MLA disclosing your personal information to third parties for the purpose of managing the Event. Any organisation which MLA provides your personal information to will be obliged to handle your personal information in accordance with applicable privacy laws.
(c) Disclosure of your information to payment processor
In addition to the collection of personal information as set out in MLA’s Privacy Policy, you consent to Stripe Payments Australia Pty Ltd (ABN 66 160 180 343) (“Stripe”) collecting your personal information to process payments made by you on this platform through its payment system. Stripe is contactable through its website www.stripe.com/au and you have a right to request Stripe to provide you with any personal information Stripe has collected relating to you.
(d) Consent for marketing purposes
You unconditionally consent to MLA disseminating your name and any images, photographs, or videos taken of you during any Event which you attend for the purpose of providing information about the particular Event or for marketing and advertising future Events.
You consent to MLA sending you marketing materials for future Events. You may opt out of receiving such materials at any time by clicking the “unsubscribe” button at the bottom of the relevant communication.
Notwithstanding the fact you may unsubscribe from receiving marketing materials, if you attend an Event you unconditionally consent to receiving post-Event surveys from MLA.
4. Intellectual property
(a) MLA materials
All of the intellectual property rights in any materials used to advertise an Event or provided to you at or in connection with an Event belong to MLA and its licensors.
You may use such materials for your own personal use, but you may not use the materials for any commercial purpose, reproduce any part of the materials or share the materials with any other person without MLA’s prior written consent.
(b) your content
To the extent that you provide any materials to MLA as part of an Event (“your content”):
- you remain the owner of your content;
- you grant MLA an irrevocable, worldwide, perpetual, non-exclusive licence to use, reproduce and communicate to the public your content for the purposes of marketing, advertising and operating Events; and
- you must ensure that your content does not include anything that is illegal, offensive, obscene, defamatory or that breaches the intellectual property, privacy or other rights of any other person.
5. General
(a) Survival of terms
All provisions of these terms that by their nature should survive completion of the Event shall survive, including all limitations on liability, releases, indemnification obligations, disclaimers, choice of law and intellectual property protections.
(b) Severance
If any provision of these terms is held to be void, unenforceable or illegal, that provision will be severed, and the remaining provisions will have full force and effect.
(c) Governing law
These terms are governed by the laws in force in New South Wales and will be subject to the non-exclusive jurisdiction of the courts in New South Wales.
